The following terms and conditions apply to all transactions and commercial relationships between the Customer and Meridianosedici Dtl GmbH, Postfach 301732 D-10747 Berlin, registered in the Company Register of the Berlin – Charlottenburg Court HRB 94199B – International VAT No. DE 237815017; owner of the Dalmedio® brand, under which it will hereinafter be referred to.
These terms and conditions apply specifically to the sale of Extra Virgin Olive Oil products. The customer is required to read them, as placing an order implies acceptance of these terms.
In any case, to avoid misunderstandings, these terms will also be printed on the back of the order confirmation.
No different conditions are permitted unless specifically agreed upon beforehand and in writing.
Dalmedio reserves the right to modify the terms and conditions at any time without providing justification.
No changes will be applied to orders already in progress.
Prices
a) All prices displayed on the Dalmedio website for retail sales are final, meaning they include VAT and shipping costs.
b) Offers and related prices are valid at the time the customer places the order. Dalmedio reserves the right to change offers and prices at any time without prior notice.
Orders
a) Every order placed by the Customer constitutes a conscious and voluntary acceptance of an offer proposed by Dalmedio, which must always be understood as a simple invitation to purchase.
b) Upon receiving the order, Dalmedio will send the customer an order confirmation via email, expressly inviting them to verify its accuracy within 3 days.
c) Only if no objections are communicated in writing — including via email — within 3 days, the order will be considered a definitive acceptance of the initial offer, confirmed, and therefore a binding contract.
Payments
Payments must be made in advance and can be completed via bank transfer or PayPal. Payments are considered completed only once the amount has been credited to the seller’s bank account.
Deliveries
a) Delivery times will always be clearly indicated on the order confirmation and are calculated from the business day following receipt of payment.
b) Normally, delivery times are 3–4 business days.
For delivery times exceeding 15 days, if not acceptable to the Customer, they may notify Dalmedio and/or withdraw from the order under the same terms described in Orders b) and c).
c) Dalmedio reserves the right to ship and invoice items from the same order separately.
d) Delays in delivery due to force majeure or causes not directly attributable to Dalmedio cannot be charged to Dalmedio under any circumstances.
e) If, for any reason, a shipment is returned because it was not collected by the Customer, Dalmedio will notify the customer via email, but all return costs, damages, and costs for reshipping will be entirely borne by the Customer.
f) Under no circumstances can compensation be claimed for delayed delivery or withdrawal from the contract.
Transport Risks
Dalmedio assumes the risk of damage occurring to goods during transport by replacing them, but only if such damage is explicitly noted and clearly detailed in writing to the delivery agent at the time of delivery, and immediately afterward to the seller with all relevant information.
No replacement will be made for damage without the above conditions being met.
Right of Withdrawal
a) The customer may withdraw from the contract within 14 days of receiving the goods, provided that this is communicated to Dalmedio in writing — including via email — within the deadline. The seller will promptly confirm the withdrawal with a return code, after which the goods must be shipped back within 3 days.
b) To be eligible for withdrawal and refund, Dalmedio Extra Virgin Olive Oil packages must be returned intact, unopened, sealed, undamaged, and with all original external protective elements as delivered. Only after verification will a refund be issued within 2 days.
c) All transport costs for returning the goods will be borne by the customer, as well as all risks of transport damage. Any parcels sent with postage due will be refused.
Warranty
a) Dalmedio guarantees, in accordance with the law, that the products sold correspond to their description and are free from defects.
b) Any obvious defects, incorrect product type, or incorrect quantity must be reported to Dalmedio in writing — including via email — immediately upon receipt of the goods, accompanied by an adequate description. Only in this case will they be considered for corrective action.
c) The only contractual reference for the type, quality, and quantity of oil contained in Dalmedio Extra Virgin Olive Oil packages is the description visible in the order form titled “the packages.”
d) The sections on the website, explanations, interviews, advertisements, and all information regarding the effects or use of Extra Virgin Olive Oil are provided for informational purposes only and without any guarantee. Dalmedio declines all responsibility for such content; under no circumstances may they be considered part of the sales contract.
e) Dalmedio assumes no responsibility for printing errors or content errors on the website. The right to make mistakes is expressly reserved.
